Minute of the Board of Adjustments Meeting

Thursday, January 6th, 2011

 

Item # 1          The Board of Adjustments meeting was called to order by Chairman Sebranek at 1:00 pm. Those present or who signed up to speak were Randy Sussek, Ross and Theresa Halverson, Allen Rippchen, Randy Heims, Gilman Moe, Tom McGlynn, Larry Sebranek, Harriet Pedley and Cheryl Dull taking minutes.

 

Item #2           Pedley stated that the meeting was properly published in the Richland Observer for 2 weeks and posted on the bulletin board in the courthouse. Motion by Moe, seconded by Heims, to approve the publication and agenda. Motion carried.

 

Item #3           Sebranek noted 2 changes in the November 4, 2010 minutes. Names were spelled incorrectly in the minutes and they will be corrected. Sebranek  declared the minutes approved as corrected.

Item #4           The Board heard a petition from Rodney Sussek to request a variance to the required parcel size of 35 acres in the General Agriculture and Forestry zoning district to 33.22 acres in Section 13 of Willow Township. Sussek stated when he bought the property from Dennis Ekleberry, he was told it was 35 acres. When an appraisal was done recently it was discovered it was 33.22. No neighbors were heard from.  Motion by Moe and a second by Heims to vary the parcel size for Rodney Sussek from 35 acres to 33.22 acres in the General Agriculture and Forestry district.  All members reviewed the petitioner’s claim of unnecessary hardship by Sussek and other information in their packets and voted in favor for the same reasons. Motion carried.

 

Item #5           The Board heard a petition from Ross & Theresa Halverson to request a variance to the requirement of not more than one secondary structure on a parcel zoned Residential-2 to allow three (existing) additional secondary structures in Section 35 of Buena Vista Township. Halverson explained that they want to move an old mill from Old Mill Rd to his property in Section 35.  He was contacted recently by the owner who said would be interested in selling it.  Halverson’s intention is to move the old mill to their site and remodel it into a home for them.  Halverson contacted a moving company who advised him it could be moved without any problem. Halverson has permission to move it across the fields of Marty Sprecher and Albert Greenheck which would eliminate the removal of several electric lines and reduce the cost significantly although it must be moved in February while there is still frost in the ground. That would allow them 50-60 days to get a foundation ready to set it on. They are asking for the variance so they can keep the secondary structures on the property. Pedley told the board members that the property they own was previously rezoned to Residential-2 in 2005.  One of the existing structures is an old home that is past preserving but is used for storage. They can meet the setbacks where the building will be set. A neighbor, Ann Greenheck, had called and is very much in support of the project.  Motion by Moe and second by McGlynn to approve the variance request of having more than one secondary structure on the parcel with all members reviewing the same material and voting for the same reasons. Motion carried.

Item # 7          There is one petition filed for the next meeting which is Thursday, February 3rd at 1:00 pm.  Motion by Heims, seconded by McGlynn to adjourn at 1:25 pm. Motion carried.
