Minute of the Richland County Board of Adjustment Committee Meeting

Item # 1 The Board of Adjustments committee meeting was called to order by Chairman Heims at 1:00 pm. Those present or who signed up to speak were Larry Sebranek, Allen Rippchen, William Seep, Michael Bindl, Tom McGlynn, with Cheryl Dull taking minutes..
Item #2 Motion by Sebranek, seconded by Rippchen, to approve the publication and agenda. Motion carried.
Item #3 Moved by Heims to declare the minutes approved as presented.
Start of Public Hearing 1:02 pm
Item #4 The committee heard a petition of James Daniels to variance for 2 existing residences to the required 2 acre minimum lot in Residential 2, a variance to the side yard setback of 10 feet and a combined side yard of 20 feet, and a variance to the minimum setback of 110 feet to a Class C highway in Section 14 of Westford Township.
Bill Seep is in attendance for the Township to say they are in support of the variance. It is to settle an estate that has 2 houses which is to be split by the 2 sons. No one is here to represent the petitioner. Bindl stated it is 3 lots that will be split into 2 with the new survey and the houses are on village sewer. The variance is for lot size, building set back to the lot line and set back to the highway. It is currently zoned commercial, next week they are going before the zoning committee to be rezoned to R-2. There was one neighbor heard from that didn’t have a problem.
It has been a practice to table the petitions if no one is present to represent the petitioner. Motion by McGlynn to table the petition due to no representation. After further discussion McGlynn withdrew his motion to table and made a motion to approve and that Daniels should be notified that he must be at the Zoning meeting. Seconded by Larry but only due to the fact that this will delay the settlement of the estate. Rippchen voted against. Motion carried.
Motion by Sebranek that in the future the board will not discuss a petition without representation for the petition, seconded by Rippchen. Motion carried.
Item #5 Bindl had sent out forms in the packets that would be used for BOA decision. Heims wondered if we want to make it part of the procedure?
Bindl stated the petitioner that was denied last month came in to get 5 years back of minutes but they have not yet filed a grievance.
Bindl told the committee that there is a Senate Bill dealing with BOA decisions. The Bill states that if the County doesn’t have a time line for a petition to expire, there will be no time line and stays with the property forever. A time line can put on it or can be put in an ordinance form.
Item # 12 Next meeting is set for January 5 at 1:00 pm. Motion to adjourn by McGlynn at 1:20, second by Rippchen. Motion carried.
