Minute of the Richland County Board of Adjustments Meeting

Thursday, November 03, 2011

 

Item # 1        The Richland County Board of Adjustments meeting was called to order by Chairman Heims at 1:00 pm. Those present or who signed up to speak were Connie Champnoise, Arthur Plachinski, Paul Kinney, Larry Sebranek, Allen Rippchen, Randy Heims, Tom McGlynn, Michael Bindl, with Cheryl Dull taking minutes..

 

Item #2         Motion by Sebranek, seconded by Rippchen, to approve the publication and agenda. Motion carried.

 

Item #3         Moved by Rippchen to make the corrections to the 10-06-11 minutes that unanimous ballot was cast for Heimes, after that change to declare the minutes approved as presented.

 

Start of Public Hearing 1:01 pm.

 

Item #4         The committee heard a petition of Arthur Plachinski and Connie Champnoise to request a variance to the required 70 feet setback from the centerline of a town road to 50 feet; a 20 foot variance in Section 15 of Akan Township to construct a new accessory structure. Connie presented that School Lane becomes a very narrow township lane past their house. They have received township approval. The reason for the variance request is they don’t want to cut down a willow tree and also want to see the garage from the house. The Board stated concerns that they don’t feel removing a tree is a hardship. Arthur stated there are not other neighbors on the lane past them, there were no complaints from neighbors, and there is no obstruction by them placing their garage where they planned to have it. He also stated that past their house School Lane is a one lane road for a farmer to get back to his field. The Board has concerns that placing the garage too close to the road would obstruct future development of the lane width.

Motion by Sebranek to deny the petition due to the rules that are in place by the ordinance, seconded by Rippchen. with all members reviewing the same materials and voting for the same reasons. Motion carried. Connie stated she plans to appeal.

 

Item #5         Bindl stated there is a form that can be presented to the County Board by the Board of Adjustments that would show when a petition is denied and for what reasons. Sebranek commented that all lanes and roads need to be kept accessible to fire and EMS.

Bindl informed the Board there will be a meeting next month for 1 application and possibly a 2nd one.

 

Item # 6                  Next meeting is set for December 1 at 1:00 pm. Motion to adjourn by Rippchen at 1:25, seconded by Sebranek. Motion carried.
