Minute of the Richland Board of Adjustments Committee Meeting

Item # 1 The Board of Adjustments committee meeting was called to order by Chairman Sebranek at 12:57 pm. Those present or who signed up to speak were Larry Sebranek, Randy Heims, Tom McGlynn, Allen Rippchen, Mike Bindl, Nevin Hillegass, and Cheryl Dull taking minutes..
Item #2 Motion by Rippchen, seconded by Heims to approve the publication and agenda. Motion carried.
Item #3 Moved by Sebranek to declare the minutes approved as presented.
Start of Public Hearing 1:59 pm.
Item #4 The committee heard a petition from Don Hillegass to request a variance to the R-1 zoning that no accessory structure shall be permitted on a lot greater than 70 % of the floor area of the principal building; a 96 % variance in Section 31 of Henrietta Township to build an accessory structure. Don son Nevin is here to represent the family. They are building a shed to put his dad’s vehicles in. when the applied for the building it was discovered that the zoning of their residence will only allow a structure to be 70% of the primary residence and that they building they want to build is almost the same size as the house. One neighbor was heard from with no objections. The property is surrounded by farmland. The Hillegass’s purchased the property in 2005 from Nevin after he had purchased a new house.
Motion by Heims, seconded by McGlynn to approve the variance request to allow for a secondary structure larger than 70% of the floor space of the primary residence, with all members reviewing the same materials and voting for the same reasons. Motion carried.
Item # 5 There was a term that expired in June for a Board Member. Bindl mentioned to the committee that they could go to 3 members with 2 alternates if they would like. Discussion followed that the board would like to keep the membership at 5 because some petitions need a lot more discussion and input. Bindl will let Ann Greenheck know that the Board of Adjustments committee is need of 3 more members. Election of officers will be held at the next meeting.
Item #6 Mike Bindl introduced himself as the Zoning administrator. He handed out packets for the next meeting as it is a very large packet and may required some extra time for the board to review it. It is for the Ray Schmitz property where they are disturbing shoreland area larger than 2000 sq ft. The permit from the DNR to run pipes under Pine River has already been approved. They are planning to disturb 80,000 sq ft which requires a public hearing.
Pedley was working on the Shoreland Ordinance before she left, hopefully it should be approved by the end of the year.
